What you're agreeing to

These terms govern your use of services provided by Opinionated Systems, Inc. ("we," "us," "our"). By accessing or using our services, you accept these terms. If you don't agree, don't use the services.

We may update these terms. Continued use after changes means you accept them.

Your account

You're responsible for keeping your account secure and for all activity under it. You must be at least 18 years old, or the age of majority in your jurisdiction, to use our services.

Provide accurate information. Don't share your credentials. Tell us immediately if you suspect unauthorized access.

Acceptable use

Use our services lawfully and respectfully. Don't:

• Violate any applicable law or regulation
• Infringe intellectual property or other rights of others
• Transmit malware, spam, or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Circumvent rate limits, safety measures, or access controls

Prohibited uses

You may not use our services to:

• Harm people — Generate content that exploits, abuses, or endangers minors; promotes violence or self-harm; harasses or threatens individuals
• Deceive — Create misinformation, deepfakes, or impersonate individuals or organizations without consent; generate fake reviews or testimonials
• Commit fraud — Engage in phishing, scams, or financial manipulation
• Provide unlicensed professional advice — Offer medical, legal, or financial advice that would require professional licensure, without appropriate oversight
• Make automated high-stakes decisions — Use AI outputs for consequential decisions about individuals (employment, credit, insurance, housing, healthcare) without human review
• Misrepresent AI involvement — Claim AI-generated content was created solely by humans, or hide AI involvement in interactions where disclosure is required
• Build competing services — Use our outputs to develop AI models, products, or services that compete with us without written permission
• Violate trade controls — Use services in embargoed countries or in violation of sanctions or export controls

AI limitations

Our services use AI systems that have inherent limitations:

• Outputs may contain errors, even when they appear detailed or confident
• Information may be outdated, incomplete, or incorrect
• AI cannot replace professional judgment in specialized fields

You should independently verify any output before relying on it for important decisions. We provide tools and sources to help you do this—use them.

Your content

You retain ownership of what you submit ("Inputs"). You grant us a license to use Inputs as needed to provide the services—including processing, storing, and transmitting them through our systems and third-party providers.

You're responsible for ensuring you have the right to share any content you submit and that it doesn't violate these terms or applicable law.

Our content

We assign you any rights we may have in outputs generated for you ("Outputs"), subject to your compliance with these terms. You're responsible for how you use Outputs, including ensuring they're accurate and appropriate for your purposes.

Our services, software, documentation, and branding remain our property. Don't reverse engineer, decompile, or attempt to extract our source code or model weights.

Payment

Paid services are billed as described at sign-up. Payments are non-refundable except as required by law. We may change pricing with notice. Unpaid accounts may be suspended or terminated.

Termination

You can stop using our services anytime. We can suspend or terminate access if you violate these terms or if required by law. We may also discontinue services with reasonable notice.

Upon termination, your right to use the services ends. Provisions that should survive (like liability limits, indemnification, and dispute resolution) will continue to apply.

Disclaimer of warranties

Services are provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

We don't guarantee uninterrupted or error-free operation, that outputs will be accurate or suitable for any purpose, or that the services will meet your requirements.

Limitation of liability

To the maximum extent permitted by law, we're not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

Our total liability for any claim is limited to the greater of: (a) the amount you paid us in the six months before the claim, or (b) $100.

These limits apply even if we've been advised of the possibility of damages and even if any remedy fails its essential purpose.

Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including legal fees) arising from: your use of the services, your violation of these terms, your violation of any law or third-party rights, or content you submit.

Disputes

These terms are governed by the laws of Delaware, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

General

These terms are the entire agreement between you and us regarding the services. If any provision is unenforceable, the rest remains in effect. Our failure to enforce any right isn't a waiver. You can't transfer your rights under these terms without our consent.
